Subdivision Procedures

GENERAL GUIDE TO OBTAINING MUNICIPAL APPROVALS

(I) Are you intending to develop your property?

If you are thinking of developing your property, this schedule will explain how to go about it, why certain procedures must be done and where you can find information.

(II) Why are approvals needed?

Everyone wanting to develop land in Valemount or to change the use of land must obtain approval from the Village of Valemount. Under the Local Government Act, municipalities across British Columbia are given the power to plan for their future and to ensure that all development agrees with certain standards designed to protect the community. These requirements are set out in the Official Community Plan Bylaw (Subdivision and Servicing Bylaw, and Zoning Bylaw) and other public documents. These rules were adopted by Council following a public hearing. Copies can be obtained or viewed at the Municipal Office, during normal office hours.

(III) Doing your Part

In order to do your part in any dealings with the Village, you should first:

• Read this bylaw to see what is required of you.
• If you feel you want to proceed, review the contents of the Official Community Plan Bylaw 595, Zoning Bylaw 610, 1998 and if a subdivision or servicing of land is required, Subdivision and Servicing Bylaw 450.
• Consider modifying your ideas so the proposed development meets the community objectives.
• Find out what costs you will be expected to bear and the time required to obtain approval for your proposal.
• Then decide whether or not to go ahead.

(IV) General Procedures to Follow

a. Before you start, check the following:

• Review the Official Community Plan Bylaw including Schedule "B" - Land Use Concept Plan.
• Also review the street network indicated on Schedule "E" of the Official Community Plan.
• Review the Zoning Bylaw to see what is required of you.
• Review the requirements of the Development Cost Charge Bylaw in order to ascertain the costs involved.
• Review Schedule “D”, development permit areas, of the Official Community Plan.
• Review the Subdivision and Servicing Bylaw and Subdivision Procedures.

b. Prepare your Proposal

• Depending on the magnitude of the proposal, you may or may not require the services of a consultant.

c. Make your Proposal

• Submit the application form
• Submit two (2) copies of the plan proposal
• Pay the required application fee

(V) General Procedure followed by the Village of Valemount

a. Acknowledgement

Council's staff will acknowledge in writing receipt of your application and then advise of Council's decision in respect of the proposal. If it is determined by Council that the matter should go to a public hearing or if Council is required to hold a public hearing, you will be advised of the time, date and location of that hearing.

b. Approval or Disapproval

You will be advised in writing by the Village Administrator about the decision made in respect of your application, and if disapproved the reasons for this decision.
